1.两高两部发布关于依法惩治新型冠状病毒有关犯罪的文件

2020年2月10日,最高人民法院、最高人民检察院、公安部、司法部联合发布《关于依法惩治妨害新型冠状病毒感染肺炎疫情防控违法犯罪的意见》。

On February 10, 2020, the Supreme People’s Court, the Supreme People’s Procuratorate, the Ministry of Justice, and the Ministry of Public Security issued the Opinions on Punishing Crimes of Hindering the Prevention and Control of the Outbreak of COVID-19 (hereinafter the ‘Opinions’).

根据《意见》,以下两种情形,成立以危险方法危害公共安全罪:1.已经确诊的新型冠状病毒感染肺炎病人、病原携带者,拒绝隔离治疗或者隔离期未满擅自脱离隔离治疗,并进入公共场所或者公共交通工具的;2.新型冠状病毒感染肺炎疑似病人拒绝隔离治疗或者隔离期未满擅自脱离隔离治疗,并进入公共场所或者公共交通工具,造成新型冠状病毒传播的。

According to the Opinions, the following two situations constitute the crime of endangering public safety by dangerous methods:

1.Those who are diagnosed with COVID-19 and are carriers of pathogens and who refuse isolation treatment or leave the isolation treatment before the quarantine period expires and enter public places or public transportation.

2.Patients suspected of having COVID-19 who refuse isolation treatment or leave the isolation treatment before the quarantine period expires and enter public places or public transportation, causing the transmission of COVID-19.

其他拒绝执行卫生防疫机构依照传染病防治法提出的防控措施,引起新型冠状病毒传播或者有传播严重危险的,依照刑法第三百三十条的规定,以妨害传染病防治罪定罪处罚。

Others who refuse to implement the prevention and control measures proposed by the health and epidemic prevention agencies in accordance with the Law on the Prevention and Treatment of Infectious Diseases, which results in transmission of COVID-19 or who are in serious danger of transmission, shall be convicted and punished for the crime of impairing the prevention and treatment of infectious diseases in accordance with Article 330 of the Criminal Law.

在疫情防控期间,故意伤害医务人员造成轻伤以上的严重后果,或者对医务人员实施撕扯防护装备、吐口水等行为,致使医务人员感染新型冠状病毒的,以故意伤害罪定罪处罚。

During the period of epidemic prevention and control, those who cause intentional injury to medical staff resulting minor injuries or more serious consequences, or who tear protective equipment of medical staff or spit on medical staff and other acts, causing medical staff to be infected with COVID-19, shall be convicted and punished for the crime of intentional injury.

此外,《意见》还对制假售假犯罪,哄抬物价犯罪,诈骗、聚众哄抢犯罪,造谣传谣犯罪,疫情防控失职渎职、贪污挪用犯罪,破坏交通设施犯罪,破坏野生动物资源犯罪,和妨害疫情防控的违法行为作出了具体规定。

In addition, the Opinions also make specific regulations on crimes on making or selling fake goods, price gouging, fraud or assembling a crowd for robbing or theft, creating or spreading rumors, breach of duty or dereliction of the duty of epidemic prevention and control, corruption or misappropriation, damage to transportation facilities, destroying wildlife resources, and illegal behaviours of impairing epidemic prevention and control.


2.四部门印发通知严惩疫情期间七类涉医违法犯罪行为

Four Departments Issued Notice to Severely Punish Seven Types of Medical-related Crimes During the Epidemic

2020年2月7日,国家卫生健康委、最高人民法院、最高人民检察院和公安部联合印发《关于做好新型冠状病毒肺炎疫情防控期间保障医务人员安全维护良好医疗秩序的通知》。

On February 7, 2020, the National Health Commission, the Supreme People’s Court, the Supreme People's Procuratorate and the Ministry of Public Security jointly issued the Notice Regarding Striving to Ensure the Safety of Medical Staff and Maintain Good Medical Order During the Period of Prevention and Control of the  COVID-19 (hereinafter the ‘Notice’).

《通知》明确疫情防控期间涉医违法犯罪防范处置工作要求,并提出7类将予以严厉打击的涉医违法犯罪情形,包括殴打、故意伤害、故意杀害医务人员的;以暴力、威胁等方法非法限制医务人员的人身自由,或者公然侮辱、恐吓、诽谤医务人员的;对医务人员实施撕扯防护用具、吐口水等行为,可能导致医务人员感染新型冠状病毒的;以暴力、威胁等方法拒不接受医疗卫生机构的检疫、隔离、治疗措施,或者阻碍医疗卫生机构依法处置传染病患者尸体的;强拿硬要或者故意损毁、占用医疗卫生机构的财物,或者在医疗卫生机构起哄闹事、违规停放尸体、私设灵堂,造成秩序混乱、影响疫情防控工作正常进行的;非法携带枪支、弹药、管制器具或者爆炸性、放射性、毒害性、腐蚀性物品进入医疗卫生机构的;其他侵犯医务人员安全、扰乱医疗秩序的情形。

The Notice provides the requirements for prevention and treatment of medical-related crimes during the period of the epidemic prevention and control, and proposes seven types of medical-related crimes that will be severely cracked down on, which includes assaulting, intentionally injuring or intentionally killing medical staff, illegally restricting the personal freedom of medical staff through violence, threats, etc. or publicly insulting, intimidating or slandering medical staff, tearing protective gear or spitting on medical staff which may cause medical staff to be infected with the novel coronavirus, refusing to accept the inspection, quarantine or treatment measures of medical institutions through violence, threats, or other methods, or preventing medical institutions from lawfully disposing of the corpses of infectious disease patients, forcibly obtaining, intentionally damaging or occupying the properties of medical and health institutions, or disturbing medical and health institutions, placing corpses in violation of regulations, and setting up private halls of worship, causing disorder and affecting the normal conduct of the epidemic prevention and control, illegally carrying firearms, ammunition, control equipments or explosive, radioactive, toxic or corrosive articles into medical and health institutions or any other situation that may violate the safety of medical staff or disrupt medical orders.


3.《关于依法从重从快严厉打击新型冠状病毒疫情防控期间违法行为的意见》发布

Issued opinions  Regarding Cracking down on Illegal Acts Resolutely, Severely and Rapidly in Accordance with the Law During the Period of Prevention and Control of the Outbreak of Novel Coronaviruses

2020年2月6日,市场监督管理总局发布《关于依法从重从快严厉打击新型冠状病毒疫情防控期间违法行为的意见》。

On February 6, 2020, the State Administration for Market Regulation issued the Opinions Regarding Cracking down on Illegal Acts Resolutely, Severely and Rapidly in Accordance with the Law During the Period of Prevention and Control of the Outbreak of Novel Coronaviruses (hereinafter the ‘Opinions’).

《意见》要求,对涉及疫情防控的违法行为,考虑其特殊危害性,从重处罚。对野生动物及其制品非法交易、口罩等防护用品制假售假等违法行为,在依法可以选择的处罚种类和处罚幅度内顶格处罚。对哄抬防护用品及制作原材料和基本民生商品价格等违法行为,在依法可以选择的处罚种类和处罚幅度内,适用较重、较多的处罚种类或者较高的处罚幅度进行处罚,其中罚款的数额应当在从最低限到最高限这一幅度中较高的30%部分。涉嫌犯罪的,必须坚决移送司法机关依法追究刑事责任。

The Opinions require that illegal acts involving epidemic prevention and control should be punished severely based on the nature of their special harm. For illegal acts such as trading wild animals and their products, making or selling fake protective products such as masks, and among others, the most severe punishment should be imposed within the types and ranges of punishment that can be selected according to law.

For illegal acts such as price gouging of protective supplies and materials and basic livelihood commodities, heavier and varied punishment, or a higher range of punishment should be applied from among the types and ranges of punishment that can be selected in accordance with the law, and the amount of fine should be chosen from the higher 30% portion from the minimum to the maximum. Anyone who is suspected of committing a crime must be resolutely transferred to a judicial organ to hold criminal liability.

根据《意见》,各省级市场监管部门在不违反法律、行政法规的情况下,可以根据当地疫情防控需要,简化执法和听证程序,压缩办案时限,提高应当进行听证案件的罚款数额下限,积极运用电子送达、在线听取当事人陈述和申辩等简便迅捷的方式优先加快办理与疫情防控相关的违法案件,具体举措由各地自行决定。

According to the Opinions, without violating laws and administrative regulations, with the needs of local epidemic prevention and control, provincial market regulation departments can simplify law enforcement and hearing procedures according to local epidemic prevention and control needs, reduce the time limit to handling cases, increase the lowest limit for fines that should be heard, and actively use quick and easy methods such as electronic delivery and online listening to parties' statements and pleas to handle illegal cases involving epidemic prevention and control in priority and quickly. Local authorities can determine specific measures.

4.国务院发通知切实加强疫情防控

State Council Issued Notice to Strengthen Epidemic Prevention and Control

2月8日,国务院应对新型冠状病毒感染肺炎疫情联防联控机制印发《关于切实加强疫情科学防控 有序做好企业复工复产工作的通知》。

On February 8, the State Council's Joint Prevention and Control Mechanism for Countermeasures for COVID-19 issued the Notice Regarding Effectively Strengthening Scientific Prevention and Control of Outbreaks and Orderly Resuming Operation and Production of Manufacturers (hereinafter the ‘Notice’).

《通知》主要包括:一要推动分批有序错峰返程返岗,统筹制定分类分批复工复产方案,疫情防控、能源供应、交通物流、城乡运行、医用物资和食品等生活必需品生产、饲料生产、市场流通销售等涉及重要国计民生的领域,要保障条件立即推动复工复产,重大工程和重点项目员工要及时返岗、尽早开工。二要全力做好交通运输组织保障,铁路、民航等要统筹运力做好重点群体运输,并切实降低疫情传播风险。三要分级分类提升核酸检测等快速筛查能力,在确保安全的前提下,扩大覆盖范围,提高筛查速度。四要加强重点人群隔离和病例收治。五要指导企业认真落实各项防疫要求,各企业要根据生产经营特点,认真做好复工复产前以及生产过程中检测筛查、通勤保障、个体防护等疫情防控工作。六要加快推进全产业链协调运行,建立重点企业派驻联络员制度,及时协调解决机器、用工、资金不足等问题,抓好原辅料、重要零部件等稳供保障。七要全面抓好安全生产和社会稳定,做好防疫物资、仓储物流、运输配送等重点企业重大安全风险隐患排查。八要努力提高公共服务保障能力,在保障一线医护人员防护物资的基础上,努力满足公共服务岗位防护需求,通过多种方式切实降低企业负担。

The Notice includes the following aspects:

The first aspect regards promotion of an orderly, off-peak and batch return to work and an overall formulation of a scheme of classified and batch resumption of operation and production. Conditions for immediate operation and production resumption in areas involving important national economy and people's livelihoods such as epidemic prevention and control, energy supplies, transportation and logistics, urban and rural operations, medical supplies, production of food and other life necessities, feed production and market circulation and sales should be guaranteed, and employees of key projects and key programs should timely return to and start their work as early as possible.

The second aspect regards good organization and guarantees of transportation. Overall planning on transportation capacity should be made and group transportation should be well carried out in railroads and civil aviation, and risks of epidemic transmission must be effectively reduced.

The third aspect regards classified enhancement of the rapid screening capabilities of nucleic acid detection in order to expand the coverage and speed of screening on the premise of safety guarantees.

The fourth aspect regards strengthening the isolation and treatment of key groups of people.

The fifth aspect regards guidance for enterprises’ earnest implementation of every epidemic prevention and control requirement. All enterprises should, according to the characteristics of production and operation, conscientiously do a good job in epidemic prevention and control such as detection and screening, commuting guarantee, and personal protection before and during the resumption of operation and production.

The sixth aspect regards accelerated promotion of the coordinated operation of the entire industry chain and establishment of the system for assigning liaisons to key enterprises to timely coordinate and solve problems such as insufficient machinery, labor, and funds, as well as to ensure steady supply and guarantee of raw auxiliary materials and important components.

The seventh aspect regards overall safe production and social stability, as well as effective check in major potential safety risks in key enterprises such as materials for epidemic prevention, warehousing and logistics, and transportation and distribution.

The eighth aspect regards requirements for hard work to improve the security capabilities of public service. On the basis of ensuring protective supplies for front-line medical personnel, the protection requirements of public service positions must be met and the burden on enterprises should be reduced through various methods.


5.疫情期间稳定劳动关系支持企业复工复产的意见

Opinions on Stabilizing Labor Relations and Supporting Production Resumption by Enterprises During the Period of Epidemic

2020年2月7日,人力资源社会保障部,中华全国总工会,中国企业联合会/中国企业家协会,中华全国工商业联合会发布了《关于新型冠状病毒感染肺炎疫情防控期间稳定劳动关系支持企业复工复产的意见》。

On February 7, 2020, the Ministry of Human Resources and Social Security, All-China Federation of Trade Unions, China Enterprise Confederation/ China Enterprise Directors Association, and the All-China Federation of Industry and Commerce issued the Opinions on Stabilizing Labor Relations and Supporting Production Resumption by Enterprises During the Period of the Prevention and Control of the Outbreak of Novel Coronavirus-Related Pneumonia.

《意见》要求,对因受疫情影响职工不能按期到岗或企业不能开工生产的,有条件的企业可安排职工通过电话、网络等灵活的工作方式在家上班完成工作任务;对不具备远程办公条件的企业,与职工协商优先使用带薪年休假、企业自设福利假等各类假。在受疫情影响的延迟复工或未返岗期间,对用完各类休假仍不能提供正常劳动或其他不能提供正常劳动的职工,指导企业参照国家关于停工、停产期间工资支付相关规定与职工协商,在一个工资支付周期内的按照劳动合同规定的标准支付工资;超过一个工资支付周期的按有关规定发放生活费。

According to the Opinions, for employees affected by the epidemic that cannot work on time or the enterprise cannot start production, conditional enterprises can arrange employees to work at home to complete work tasks through flexible working methods such as telephone and Internet; For enterprises that do not have remote working conditions, they can negotiate with employees to use various vacations such as paid holidays each year and enterprise-established welfare vacations.

During the period of delayed work resumption or non-return to work due to the epidemic, for employees who still are unable to work after running out of various vacations or other employees that are unable to work, authorities should guide enterprises to consult with employees with reference to the relevant provisions of the state on wage payment during the period of furlough and suspension production. Within one wage payment cycle, wages should be paid as agreed in labor contracts; beyond one wage payment cycle, living expenses will be paid in accordance with relevant regulations.

《意见》采取多种措施减轻企业负担,如提供在线免费培训,开放“中国职业培训在线”平台全部功能,免费提供培训教学资源。

The Opinions adopt various measures to reduce the burden on enterprises, such as providing free online training, opening up all the functions of the "China Vocational Training Online", and providing training and teaching resources for free.


6.工信部出台20条政策措施支持中小企业复工复产渡过难关

2020年2月9日,工信部印发《关于应对新型冠状病毒肺炎疫情帮助中小企业复工复产共渡难关有关工作的通知》。

On February 9, 2020, the Ministry of Industry and Information Technology issued the Notice on Responding to the COVID-19 Epidemic and Supporting Small and Medium-sized Enterprises in Resuming Work and Production and Overcoming Obstacles (hereinafter the ‘Notice’).

《通知》提出,帮助企业协调解决职工返岗、原材料供应、物资运输以及口罩、消杀用品、测温仪等防控物资保障等难题。推动有关单位对疫情期间中小企业生产经营所需的用电、用水、用气,实施阶段性缓缴费用,缓缴期间实行“欠费不停供”措施。加大企业复产用工保障力度,精准摸查发布企业用工需求信息,推进线上供求匹配对接和远程招聘,加强本地供需对接,满足企业阶段性用工需求。

The Notice sets out that enterprises should be supported in coordinating and solving problems such as employee return, raw material supply, material transportation, and materials for prevention and control such as masks, disinfection supplies and thermometers, among others. The relevant entities should be promoted to implement phased deferred payment of electricity, water and gas required for the production and operation of small and medium-sized enterprises during the epidemic period, and implement the measure of ‘non-stop offering at arrears’ during the deferred period. The guarantee for resumption of work and production should be increased, the information on enterprise employment needs should be accurately surveyed and released, the online matching between supplies and demands and remote recruitment should be promoted and the local supply and demand integration should be strengthened to meet the company's periodic employment needs.

《通知》要求,推动金融机构对有发展前景但受疫情影响暂遇困难的中小微企业,适当下调贷款利率,增加信用贷款和中长期贷款,不得盲目抽贷、断贷、压贷,对到期还款困难的,可予以展期或续贷。

According to the Notice, financial institutions are promoted to appropriately lower the loan interest rate, increase credit loans and both medium and long-term loans, not blindly draw down, break down, or press loans, and even extend or renew loans to the micro, small and medium-sized enterprises that have promising prospects but are temporarily experiencing difficulties as a result of the epidemic.

此外,在进一步加强对中小企业的创新支持方面,《通知》鼓励“专精特新”小巨人企业和“专精特新”中小企业针对新冠肺炎防治,在检测技术、药物疫苗、医疗器械、防护装备等方面开展技术攻关和生产创新,并提出要大力推广面向中小企业的互联网平台服务,积极推行网上办公、视频会议、远程协作和数字化管理。

In addition, in the aspect of further strengthening innovation support for small and medium-sized enterprises, the Notice encourages giant enterprises and small and medium-sized enterprises with “specialization, sophistication, particularity and distinctness” to carry out technical research and production innovation on the prevention and treatment of the COVID-19 in the areas of detection technology, drug vaccines, medical devices, protective equipment, etc., and also vigorously promotes Internet platform services for small and medium-sized enterprises, as well as actively promotes online office, video conference, remote collaboration and digital management.

7.三部门印发《关于发挥政府储备作用支持应对疫情紧缺物资增产增供的通知》

2月7日,国家发改委、财政部、工信部发布《关于发挥政府储备作用支持应对疫情紧缺物资增产增供的通知》。

On February 7, the National Development and Reform Commission, the Ministry of Finance, and the Ministry of Industry and Information Technology issued the Notice Regarding Playing Governments' Reservation Function to Support the Production and Supply Increase of Scarce Supplies for Countermeasures for the Epidemic (hereinafter the ‘Notice’).

根据通知,第一批政府兜底采购收储的产品目录包括:医用防护服,N95医用级防护口罩,医用外科口罩,医用一次性使用口罩,生产医用防护服、医用口罩等重要原材料,医用护目镜、防护面屏、负压防护头罩,医用隔离衣,新型冠状病毒核酸检测试剂盒,全自动红外体温检测仪,经卫生健康、药监部门依程序确认治疗有效的药品和疫苗。

According to the Notice, the catalogue of the first batch of products to be given catch-all purchase and reservation by the government include the following: medical protective clothing, N95 masks for medical protective purposes, medical surgical masks, disposable medical masks, important raw materials for production of medical protective clothing, medical masks and other medical supplies, medical goggles, face shields, negative pressure protective hoods, medical isolation gowns, new coronavirus nucleic acid detection kits, full-automatic infrared thermometers, and the medicines and vaccines that have been confirmed to be effective for treatment by the health and drug supervision department according to procedures.

《通知》明确,对《产品目录》中企业多生产的重点医疗防护物资,全部由政府兜底采购收储。此外,《通知》要求,要进一步加强应急物资储备建设,特别是要增加应对公共卫生事件重要物资的政府储备规模,在项目立项建设、资金补贴、用地、用能、融资等方面给予政策支持。

The Notice specifies that all surplus key medical protective supplies in the Product Catalogue produced by enterprises will be purchased and reserved by the government.  In addition, the Notice requires that the construction of reserves of emergency supplies be further strengthened. In particular, the scale of government reserves of important supplies for coping with public health events should be increased, and policy support should be given to project construction, capital subsidies, land use, energy use, and financing, among others.


8.《关于打赢疫情防控阻击战 强化疫情防控重点保障企业资金支持的紧急通知》发布

2020年2月7日,财政部与国家发展改革委、工业和信息化部、人民银行、审计署联合发布《关于打赢疫情防控阻击战 强化疫情防控重点保障企业资金支持的紧急通知》。

On February 7, 2020, the Ministry of Finance, the National Development and Reform Commission, the Ministry of Industry and Information Technology, the China People’s Bank and the National Audit Office jointly issued the Urgent Notice Regarding Winning the Fight of the Epidemic Prevention and Control, Strengthening the Epidemic Prevention and Control and Focusing on Corporate Financial Support (hereinafter the ‘Notice’).

通知要求,进一步加大资金支持力度,规范资金管理,对疫情防控重点保障企业实行名单制管理,并动态调整。对名单内企业,人民银行通过专项再贷款支持金融机构提供优惠利率信贷支持。中央财政按企业实际获得贷款利率的50%给予贴息。

The Notice provides that, funding support should be further increased, fund management should be regulated, list management is implemented  for enterprises that are given key guarantee for epidemic prevention and control, and dynamic adjustment may be made. The People's Bank of China supports financial institutions in providing preferential interest rate credit support to the companies on the list through special re-loans. The Central Finance should supply a discount of 50% of the actual loan interest rate obtained by the enterprises.

通知明确,实施疫情防控重点保障企业名单制管理的企业包括:生产应对疫情使用的医用防护服、隔离服、医用及具有防护作用的民用口罩、医用护目镜、新型冠状病毒检测试剂盒、负压救护车、消毒机、消杀用品、红外测温仪、智能监测检测系统和相关药品等重要医用物资企业;生产上述物资所需的重要原辅材料生产企业、重要设备制造企业和相关配套企业;生产重要生活必需品的骨干企业;重要医用物资收储企业;为应对疫情提供相关信息通信设备和服务系统的企业以及承担上述物资运输、销售任务的企业。

According to the Notice, enterprises that are given focused guarantee for epidemic prevention and control and are managed by implementing list system include companies that produce important medical supplies, such as medical protective clothes, isolation clothes, medical and protective civilian masks, medical goggles, novel coronavirus detection kits, negative pressure ambulances, disinfection machines, disinfection supplies, infrared thermometers, intelligent monitoring and detection systems and related drugs used for the response to the epidemic. This also includes companies that produce important raw and auxiliary materials, companies that manufacture important equipment and related supporting companies, as well as backbone companies that produce important daily necessities, companies that collect and store important medical supplies, companies that provide relevant information and communication equipment and service systems for the response to the epidemic, and companies that undertake the transportation and sale tasks of aforementioned supplies.


9.两部门发通知规范疫情防控期间学生资助工作

Two Departments Issued Notice to Regulate Student Aid During Period of Epidemic Prevention and Control

2月6日,教育部、财政部印发《关于做好新型冠状病毒感染肺炎疫情防控期间学生资助工作的通知》。

On February 6, the Ministry of Education and the Ministry of Finance issued the Notice Regarding Student Aid During the Period of the COVID-19 (hereinafter the ‘Notice’).

《通知》明确,各地各校学生资助管理部门要根据有关部门及学校掌握的疫情信息,及时了解本地本校家庭经济困难学生的身体和生活等情况。要重点聚焦疫情严重地区、贫困地区、农村地区、边远地区,重点关注低保、残疾等特殊困难学生群体。各地各校应充分考虑疫情期间家庭经济困难学生的实际需求,及时足额发放国家助学金等资助资金。

The Notice specifies that the student aid administrations of all schools in each location should, in a timely manner, learn about the physical and living conditions of the students with financial difficulties in local schools, based on the epidemic information held by relevant departments and schools. Areas with severe epidemics, impoverished areas, rural areas, and remote areas should be focused on, and more attention should be paid to groups of students with special difficulties, such as households who have minimum living guarantees and those who are disabled. All localities and schools should give full consideration to the actual needs of students with financial difficulties during the epidemic period and both timely and fully distribute national grants and other aiding funds.

此外,对于已经毕业且处于还款期的国家助学贷款借款学生,在疫情防控期间因受疫情影响不能正常还本付息的,依据相关文件,可合理延后还款期限。如因患新型冠状病毒感染肺炎失去还款能力的,要协调经办银行启动救助机制,为其办理代偿应还本息相关手续。

In addition, for those graduated students who are still in the period of repayment of national student loans but who fail to repay the principal and interest as normal during period of epidemic prevention and control as a result of the impact of the epidemic, the repayment period can be reasonably delayed for them according to relevant documents. If someone has lost the ability to make repayments due to COVID-19, a rescue mechanism should be initiated by coordinating with the handling bank and related procedures for repaying the principal and interest should be initiated.
